Napster orders Offspring to stop pirating Napster logo

This is almost too real to be real.

A story at Sonicnet.com says that Napster, Inc. has issued a cease and desist order to the band Offspring to stop selling merchandise imprinted with the Napster logo.

"We've already said you guys [can use] our stuff - we're gonna do yours, too." - source close to the Offspring.

Can it possibly get more ugly and comical than this?? I think I will buy a pirated Napster T-shirt from The Offspring to show my support for exposing this hypocrisy. But then you knew Napster was all about money, not freedom, didn't you?

this is great. i've been an offspring fan for years and am *thrilled* by what they have done. i think it is the perfect test, i've sat mostly in the middle with the napster issue. on one hand i think "it can't be stopped, so why bother?" and "information wants to be free". on the other i think lars has some good points and if i were in his situation i wouldn't be all that pleased with napster either. from his comments in various places he makes it fairly clear that his main issue is not with pirated copies of metallica's music but with a for profit organization making money for shareholders with pirated copies of his music. by selling napster's stuff on their web site offspring has perfectly turned the tables, and if napster has *ANY* common sense they will laugh and turn a blind eye to it. if they don't they may well find themselves no longer the media darlings they've mostly been so far.

Let's throw the whole story up, eh? Napster really has no choice, they have to defend their trademark or they risk losing it. Although I'm sure if they really wanted to they could have figured out an "on paper only" licensing deal with The Offspring to put the matter to rest.

This is the most ironic story, what does napster stand to gain, by pissing off well known artists, who were only showing their support of napster in the first place. I would think napster would only want to support this sort of activity, in an effort to get more bands to do similar things.

I noticed this story on That Other Site(TM) as well, but *I* saw it on K5 moderation first. I don't mind if there is some story overlap between K5 and ./, since I don't read ./ every day.

K5 is on my short list (along with Salon and Unisci) of sites that are daily must-reads.

As someone has posted on that other site, lets just stop and laugh for a second at the money hungry Napster company and their silliness, and get working on improving Gnutella. Gnutella and its clones will definately scoop Napster and the RIAA; its general nature as a file sharing program make it much more powerful.

Dump it or at least amend it to note that Napster and Offspring have already come to a licensing agreement and Offspring will continue to sell Napster t-shirts and donate the proceeds to charity.

Actually I'm pretty impressed by the Offspring. Not only did they allude to the Metallica vs. Napster cartoon ("T-shirts... GOOD!") they also got Napster to point out that they're, after all, just another company:

"It would be very interesting if they would go, 'We're going to send them a cease and desist [order]... 'cause that would... expose a huge hypocrisy."
