Judiciary Abdicated. Republic Dead. All Hail Emperor Obama!

On April 6th of last year, community organizer and Nobel laureate Barack Hussein Obama signed an executive order authorizing the extra judicial targeted killing (murder in the vernacular) of an American citizen. No big deal. Presidents overstep their bounds all the time. I'm sure it will all get cleared up in the courts, right?

Wrong.


US District Judge John Bates' decision is a pathetic attempt to rationalize the presence of a giant pussy where his balls once resided. My favorite argument as to why Mr. al-Aulaqi should surrender himself to people who have orders to shoot him on sight:
"All U.S. citizens may avail themselves of the U.S. judicial system if they present themselves peacefully, and no U.S. citizen may simultaneously avail himself of the U.S. judicial system and evade U.S. law enforcement authorities.
Anwar al-Aulaqi has not been accused of a crime. No warrant has issued for his arrest. They tried to get him on passport fraud back in '02, but the warrant was rescinded when the guy they got to prosecute Mr. al-Aulaqi pointed out that the statute of limitations had expired. He has since left the United States.

While we have been bombing the shit out of them, the US is not at war with Yemen, nor are they a NATO member, so claims of military self-defense are moot. If the Obama administration wishes to claim authority under AUMF, he can present evidence Mr. al-Aulaqi was involved in the 9/11 attacks in a court of law. Of course, if such evidence existed, the Bush administration would have nabbed him when he was leading prayers on Capitol Hill. No doubt what evidence they do have against Mr. al-Aulaqi was obtained by unconventional means and of no use in a court of law.

Well, tough shit, Obama. Either we as citizens of the United States of America have the right to due process or the rule of law means nothing; the social contract, null and void.

And yes, I will be passing through customs soon.

it is all a bit outrageous. what i'm taking away from it is that the US goverment will exploit any legal loopholes to kill and torture. where it can't find a loophole, it will kill and torture unlawfully, because the government is effectively above the law.

in a rape-or-be-raped world is there any alternative? can nice countries survive without befriending agressive countries, and keeping enemies at bay with the silent threat of their intervention?

Bates said his ruling didn't rubber stamp the assassination of us citizens, but
"Rather, the Court only concludes that it lacks the capacity to determine whether a specific individual in hiding overseas, whom the director of national intelligence has stated is an `operational' member of [Al Qaeda on the Arabian Peninsula], presents such a threat to national security that the United States may authorize the use of lethal force against him."

Surely you don't need a law degree to see that that's some fucked up logic. Nah, we can't go get him and bring him to justice and mount a normal legal case with evidence and all that because he's in hiding abroad--however, we can go hunt him down and kill him overseas because his words are a big threat. So now there's precedent for just saying expatriate X has a big mouth and he's a threat, so put him on this kill list. As a law-abiding expat myself I have to say this is very disturbing.
